Death-row inmate files suit over lethal-injection drugs
The lawsuit, filed last week by the Cobb County convicted killer Andrew DeYoung, supports the Department of Corrections must comply with the Administrative Procedure Act when it changes the way it executes condemned prisoners. Corrections spokeswoman said Monday the agency declined comment.
Corrections General Counsel Rob Jones recently said that the agency could soon pass barbituate pentobarbital, which was used in Ohio and Oklahoma, replacing sodium thiopental, which is no longer manufactured in the United States.
The Drug Enforcement Administration has recently confiscated supplies to Georgia of thiopental sodium after lawyers DeYoung asked if the state illegally obtained drugs from a pharmaceutical company in London. Seizure put executions on hold.
DeYoung is in death row for killing his parents and sister of 14 years in 1993. His trial said any proposed change in the process of lethal injection should be made available for public consultation and comment, and interested parties should be able to request a hearing.
Despite changing the way people carry Georgia, the agency "clearly has no intention of following procedures that are necessary even when agencies promulgate rules governing, for example, dog catchers, and cosmetologists Pest exterminators cons, the prosecution said. "Rather, [Corrections] has ignored the requirements of [the Administrative Procedure Act] in its efforts to quickly implement a new procedure for lethal injection, even during a federal investigation.
