Earlier this month at a Little Canada archery range, Jack Shaw shot a flight of five arrows, all bull's-eyes. One was what archers call a "Robin Hood": The arrowhead went straight into the end of another arrow and stuck there. Robin Hoods are so rare that archers keep them as trophies.

Shaw was practicing for the coming Warrior Games, a sports competition of the Defense Department and the U.S. Olympic Committee for military personnel and veterans who, because of their military service, are injured, wounded or ill. Shaw's injuries from two tours in Iraq include a bad knee suffered when he leaped out of the way as a mortar whistled by him, post-traumatic stress disorder and hearing loss.

When he needed time off work as a maintenance foreman at Metro Transit to try out for the Warrior Games, he applied for and received military leave. But when he was selected as one of 25 participants to represent the Air Force at the Olympic Training Center in Colorado Springs, Colo., his employer changed its mind and refused to give him military leave. Yet in its Warrior Games memo to commanders, the Air Force designates the competition as "TDY," or temporary duty.

Minnesota's military leave law is easy to apply in common situations: During a flood, for example, Guard members are called away from their jobs to evacuate a riverside city. Those soldiers get up to 15 days of paid leave if they work for a government entity, such as a city, a county, a state agency - or Metro Transit.

Shaw's situation is considerably more complicated and unusual. He is on the Air Force Temporary Disability Retired List: His health status has not been deemed permanent, so he is "temporarily retired" and required by law to undergo periodic evaluations by military medical experts to see if he can be recalled to active duty.

Earlier this year, Metro Transit also declined to grant Shaw military leave when he received orders to report to a Nebraska Air Force base hospital to have his disabilities evaluated for possible permanent retirement from the military. Metro Transit told him military leave doesn't cover "doctor's appointments."

Shaw, 49, of Marine on St. Croix, contacted the Watchdog, who in turn contacted the Minnesota Veterans Affairs Department, which in turn put Shaw in touch with Jim Sullivan, executive director of Minnesota Employer Support of the Guard and Reserve.
